This Service Agreement ("Agreement") is between [TVHWS LEGAL COMPANY NAME] ("TVHWS", "we", "us") and the person who purchases a plan ("you"). By creating an account and checking the agreement box, you agree to these terms. [If required in your state: insert license/registration number and regulator contact information here.]
1. What your plan covers
You choose one to four coverage areas. The number you choose sets your plan level:
| Plan | Coverage areas | Monthly | Bi-annually (6 months) | Yearly |
|---|---|---|---|---|
| Valu 1 | 1 | $45 | $260 | $510 |
| Valu 2 | 2 | $55 | $320 | $630 |
| Valu 3 | 3 | $65 | $380 | $750 |
| Valu 4 | 4 | $75 | $440 | $870 |
Coverage areas, the most we will pay for each covered repair or replacement ("cap"), and the service fee you pay per visit:
| Coverage area | Cap | Service fee |
|---|---|---|
| HVAC (heating and air conditioning) | $6,000 | $125 |
| Plumbing (supply lines, drains, water heaters, fixtures) | $1,500 | $100 |
| Appliances | $1,200–$1,500 [specify which appliances and which cap applies] | $100–$125 [specify] |
| Electrical | $1,500 | $100 |
| Washer & Dryer | $2,400 combined | $100 |
[State whether caps apply per claim, per item, or per plan term.]
Included with every plan at no extra charge: minor roof leaks, screens, door locks, and a stand-alone freezer. [Define limits for each, e.g. "minor roof leak" repair limit.]
Optional add-ons, $5 per month each: garage system, second appliances, and a stand-alone microwave. [Define caps and service fees for add-ons.]
Coverage applies only to the service address on your account and only to the items listed on your plan.
2. When coverage starts and ends
- Coverage begins [on the date your first payment is received / after a waiting period of [__] days] and runs through the "covered through" date shown in your account.
- Plans are paid in advance for the billing period you choose (monthly, every 6 months, or yearly). Paying again extends coverage for another period, starting when the current period ends.
- If a payment is not received by the covered-through date, coverage lapses. Claims cannot be filed while coverage is lapsed. [State any grace period.]
3. Changing your plan
- You can choose a different plan in your account. A new paid plan starts when your current paid period ends.
- TVHWS may, at its discretion, switch your coverage areas immediately without an additional charge. In that case your covered-through date does not change.
4. Filing a claim
- File a claim online in your account or by calling 1-844-VALU-625. Describe the problem and, if you can, include photos.
- Each claim receives a claim number. TVHWS will respond within 48 hours of receiving your claim by scheduling a technician or telling you the claim is not covered, with the reason.
- The service fee for the coverage area is due [at the technician's visit / when the claim is approved]. [State how the fee is collected.]
- TVHWS chooses the service contractor. [State whether you may use your own contractor and whether you will be reimbursed.]
- TVHWS decides whether to repair or replace a covered item. Replacement is limited to the cap and to equipment of similar features and efficiency, not brand or color. [Confirm.]
5. What is not covered
[Have your attorney finalize this list. Common exclusions in home warranty agreements include:]
- Conditions that existed before coverage began or before any waiting period ended [confirm and define].
- Damage from misuse, neglect, accidents, pests, weather, fire, flood, or other acts of nature.
- Cosmetic defects, and items not listed on your plan.
- Costs to meet building codes or permits, and to remove or dispose of equipment [confirm].
- Commercial-use equipment, or homes used as a business [confirm].
- Routine maintenance and cleaning.
- [Other exclusions.]
6. Payments
Payments are processed by Square. TVHWS does not receive or store your full card number. Prices are in U.S. dollars. [State whether sales tax applies in your state.]
7. Cancelling
[Set your cancellation and refund policy, following your state's rules. For example: "You may cancel within [__] days of purchase for a full refund if no claims were paid. After that, you may cancel at any time and receive a prorated refund of unused time, less any claims paid and a cancellation fee of $[__]."]
TVHWS may cancel this Agreement for non-payment, fraud, or misrepresentation, as allowed by law. [Confirm.]

[Attorney to draft. Typically limits TVHWS's responsibility to the caps above, and excludes secondary damage such as spoiled food, lost income, and property damage caused by a failed item, to the extent allowed by law.]
10. Disputes
[Attorney to draft: complaint process, governing law, and whether disputes go to arbitration or small claims. Include your state regulator's contact information if required.]
