TVHWS Terms & Conditions
True Value Home Warranty Services · Effective date: [EFFECTIVE DATE] · Last updated: October 27, 2026 · Version: 2026-10-27-draft
1. Agreement to These Terms
These Terms & Conditions (“Terms”) are an agreement between you and True Value Home Warranty Services (“TVHWS,” “we,” “us,” or “our”). They apply when you visit tvhws.com, create or use an account in our customer or contractor portal, contact us by phone, email or chat, or buy a home warranty plan from us (together, the “Services”).
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
If you buy a plan, your coverage is also governed by the TVHWS Service Agreement you accept at sign-up. If these Terms and the Service Agreement ever conflict about your coverage, the Service Agreement controls.
2. Who Can Use the Services
- Homeowners: You must be at least 18 years old and able to enter a binding contract. Plans cover a residential home in the United States that you own or are responsible for maintaining.
- Real estate professionals: You may share plan information with your clients. Only the person who buys the plan, or the homeowner named on it, can manage the account or file claims.
- Service contractors: Contractor accounts are created by TVHWS. Your work for TVHWS customers is also governed by your separate contractor agreement with us.
You agree that the information you give us, including your name, contact details and service address, is true, accurate and kept up to date.
3. A Home Warranty Is Not Insurance
A TVHWS plan is a home warranty, also called a home service contract. It pays for the repair or replacement of covered home systems and appliances that fail from normal wear and tear during your coverage period, up to the limits of your plan. It is not homeowners insurance and does not replace it. It does not cover damage from fire, flood, storms, accidents or other events your homeowners insurance may cover.
4. Plans, Prices and Billing
You choose one to four coverage areas: HVAC, Plumbing, Appliances, Electrical, and Washer & Dryer. The number you choose sets your plan level:
| Plan | Coverage areas | Monthly | Every 6 months | Yearly |
|---|---|---|---|---|
| Valu 1 | 1 | $45 / month | $260 / 6 months | $510 / year |
| Valu 2 | 2 | $55 / month | $320 / 6 months | $630 / year |
| Valu 3 | 3 | $65 / month | $380 / 6 months | $750 / year |
| Valu 4 | 4 | $75 / month | $440 / 6 months | $870 / year |
- Optional add-ons cost $5 per month each, billed for your whole billing period: garage system, second appliances, and stand-alone microwave.
- Included with every plan at no extra charge: minor roof leaks, screens, door locks, and a stand-alone freezer, subject to the limits in the Service Agreement.
- Payment in advance: Plans are paid in advance for the billing period you choose. The price is always calculated by our system at checkout; any price shown elsewhere is for information only.
- Payments: Card payments are processed on a secure checkout page hosted by Square. TVHWS does not receive or store your full card number. Your use of Square’s checkout is also subject to Square’s terms.
- Renewals: Plans do not renew automatically. To keep your coverage, pay for the next period from your account (“Get my pay link”) or by calling us. Paying early adds a full period to the end of your current coverage.
- Price changes: We may change prices. A new price applies only to billing periods that start after the change, never to a period you have already paid for.
- All prices are in U.S. dollars. [State whether sales tax applies.]
5. Coverage Limits and Service Fees
Each coverage area has a maximum amount we will pay for a covered repair or replacement (“cap”) and a service fee you pay for each service request:
| Coverage area | Cap | Service fee |
|---|---|---|
| HVAC (heating and air conditioning) | $6,000 | $125 |
| Plumbing (supply lines, drains, water heaters, fixtures) | $1,500 | $100 |
| Appliances | $1,200–$1,500 | $100–$125 |
| Electrical | $1,500 | $100 |
| Washer & Dryer | $2,400 combined | $100 |
Costs above the cap are your responsibility. Exactly how caps apply, which items are included in each coverage area, and when the service fee is due are set out in the Service Agreement.
6. When Coverage Starts and Ends
- Coverage begins [when your first payment is received / after a waiting period of [__] days] and runs through the “covered through” date shown in your account.
- Coverage applies only to the service address on your account and only to the items on your plan.
- If you do not pay for a new period by your covered-through date, your coverage lapses and you cannot file new claims until you pay again.
7. Requesting Service
- File a claim in your online account or call 1-844-VALU-625 (1-844-825-8625). Describe the problem and add photos if you can.
- Each claim gets a claim number. We will respond within 48 hours by scheduling a technician or explaining why the claim is not covered. Your account shows the time remaining and the status of your claim.
- TVHWS selects the service contractor. [State whether customers may use their own contractor and how they are reimbursed.] Please do not have work done before your claim is approved; we may not pay for unauthorized repairs.
- We decide whether to repair or replace a covered item. Replacements are of similar features and efficiency, not necessarily the same brand, color or model, and are limited to the cap.
- You agree to give our contractor reasonable access to your home and to the item, and to be present or have an adult present for the visit.
- Filing a false or exaggerated claim, or submitting false information, is fraud. We may deny the claim, cancel your plan and report it to the authorities.
8. What Is Not Covered
The Service Agreement contains the full list of exclusions. In general, plans do not cover:
- Problems that existed before your coverage began [or before any waiting period ended].
- Damage caused by misuse, neglect, lack of maintenance, accidents, pests, weather, fire, flood, or other acts of nature.
- Cosmetic defects, routine maintenance and cleaning, and items not listed on your plan.
- Secondary or consequential damage, such as spoiled food, water damage to floors or walls, or lost income.
- Costs to meet building codes, obtain permits, or remove and dispose of equipment, unless the Service Agreement says otherwise.
- Equipment used for commercial purposes.
9. Cancellation and Refunds
- You can cancel your plan at any time from your account (“Cancel my plan”) or by calling us. Your coverage continues until your covered-through date, and you can change your mind (“Keep my plan”) any time before then.
- Refunds, if any, follow the Service Agreement and the law of your state. [Set out refund rules, for example: a full refund within [__] days of purchase if no claims were paid; afterwards a prorated refund of unused time, less claims paid and a cancellation fee of $[__].]
- We may cancel your plan for non-payment, fraud, misrepresentation, or abusive conduct toward our staff or contractors, as allowed by law.
10. Your Account
- Keep your password private. You are responsible for activity on your account.
- Tell us right away at 1-844-VALU-625 if you think someone else has used your account.
- For your security, you will be signed out after a period of inactivity. We may place an account on hold while we look into a payment dispute or suspected fraud.
11. Acceptable Use
When using the Services, you agree not to:
- Break any law or use the Services for a fraudulent or harmful purpose.
- Try to access another person’s account or information, or any part of our systems you are not authorized to use.
- Interfere with the Services, for example by uploading malware, overloading our systems, or bypassing security features.
- Use automated tools to copy or collect content or data from the Services.
- Upload content that is unlawful, misleading, abusive, or that you do not have the right to share. Photos you upload with a claim should show only the item and the problem.
- Harass or threaten our staff, contractors, or other users, including in chat.
We may suspend or end your access to the Services if you break these Terms.
12. Our Content and Trademarks
The website, portal, text, graphics, logos and other content are owned by TVHWS or our licensors and are protected by copyright and trademark law. “True Value Home Warranty Services,” “TVHWS,” “Valu,” and our logo are our trademarks. We give you a limited, personal, non-transferable permission to use the Services for their intended purpose. You may not copy, republish, sell, or create works based on our content without our written permission.
13. Communications
By creating an account, you agree that we may contact you by email, phone, or messages in your account about your plan, payments, claims, and these Terms. We may record or keep records of calls and chats for quality and training. You can opt out of marketing messages at any time; service messages about your account will continue while you have an account.
14. Third-Party Services and Links
The Services rely on, and may link to, services run by others, such as Square for payments and independent service contractors for repairs. We are not responsible for the content, policies, or practices of third-party websites. Independent contractors are not employees or agents of TVHWS.
15. Disclaimer
Except for the coverage promised in your Service Agreement, the website and portal are provided “as is” and “as available.” To the fullest extent allowed by law, TVHWS disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the website will always be available, uninterrupted, or error-free.
16. Limitation of Liability
To the fullest extent allowed by law, TVHWS will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to a plan is limited to the applicable coverage caps in your Service Agreement, and for any other claim relating to the Services, to the amount you paid us in the 12 months before the claim arose.
Some states do not allow certain limits on warranties or damages. If those laws apply to you, some of these limits may not apply, and you may have additional rights.
17. Indemnification
You agree to cover TVHWS and our employees and agents for losses, claims, and reasonable legal fees that result from your breach of these Terms, your misuse of the Services, or information you provide that is false, to the extent allowed by law.
18. Disputes and Governing Law
If you have a concern, please call us first at 1-844-VALU-625. Most problems can be solved quickly that way. If we cannot resolve it, these Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules, and disputes will be resolved [in the state or federal courts located in [COUNTY, STATE] / by individual binding arbitration under the rules of [ARBITRATION PROVIDER]]. Either party may bring an individual claim in small claims court if it qualifies. [Attorney to finalize, including any required state regulator contact information.]
19. State-Specific Terms
Home warranty and service contract laws differ from state to state. If the law of your state requires different terms, including different cancellation, refund or complaint rights, those requirements apply to you and override any conflicting part of these Terms. [Insert any state-specific notices, licenses, or registration numbers.]
20. Changes to These Terms
We may update these Terms from time to time. We will post the new version on this page and change the “Last Updated” date. If a change materially affects customers with a plan, we will tell you by email before it takes effect. Changes to your plan coverage are made only as described in your Service Agreement. Continuing to use the Services after a change means you accept the updated Terms.
